Ignition Interlock Device Requirement
You probably have a good idea of how an Ignition Interlock works, which is to measure your breath alcohol concentration level (BrAC). The device will prompt you for a breath test before you can start your vehicle. If your BrAC is at a certain level or higher, your vehicle won’t start. The Ignition Interlock will also prompt for random running retests during your drive. An Ignition Interlock Separates Drinking From Driving® so you can get back on the road safely and legally if you have a DUI arrest and/or conviction.
When a court or state office orders the device, they are the oversight authority of your Ignition Interlock requirement period. Your court documents, or the paperwork you receive from your DMV for example, will show you how long you’ll need your Ignition Interlock in most cases. The device can be a requirement as a DUI conviction and/or to reinstate your driving privileges.
You may find that the Interlock requirement for a first-time DUI conviction without aggravating circumstances can vary anywhere from a few months to a year, however, this period can change, and not all states require Ignition Interlocks for first DUI cases. If there are other factors such as having a minor in your vehicle at the time of your DUI, or if you refused your test, your Ignition Interlock period can be extended. Second, third, or subsequent DUIs will also have longer Ignition Interlock requirement periods.
Regardless of how long you’ll need the Ignition Interlock, remember that correctly finishing the program will lead to a more seamless experience with your device.
We’re the Experts in State Regulations
All 50 states have laws on the books regarding the use of Ignition Interlock Devices. Studies have shown that Ignition Interlock Devices make the roads safer by preventing a motor vehicle from starting if there is an unlawful amount of alcohol on a driver’s breath.
So, how long do you have to have an interlock device? There are a number of factors that go into deciding this. But they vary greatly state-by-state, so it’s important to clearly understand the Ignition Interlock law and requirements from the beginning of your monitoring.
Basic Ignition Interlock FAQs

DUI Frequency is a Major Consideration
The length of time you have to keep your Ignition Interlock Device is typically correlated with the number of DUI convictions you have received. Some statesbecome progressively harsh with Ignition Interlock Device requirements after the first offense.
Regardless of which penalties apply, it’s important for Ignition Interlock users to stay current with device calibrations and all other requirements. In most states, missing these appointments can result in your Ignition Interlock Device not working properly, making you subject to additional penalties.
Stay on Top of Your Testing
Alcohol Levels Also Make a Difference
In virtually every state, the legal limit for DUI is blood alcohol content (BAC) of .08 or higher. However, there are a number of exceptions. For example:
- In Utah, the legal BAC limit is .05.
- Commercial drivers typically have a limit of .04.
- For drivers under 21, the levels range from zero tolerance to .08.
Higher BAC levels typically require harsher penalties. Some states have established the threshold for felony DUI as any level higher than 0.15. This often has a great impact on the required length of Ignition Interlock Device usage. Felony DUI often involves longer use.
Misdemeanor DUI vs. Felony DUI
Judicial Discretion and Other Factors
In many jurisdictions (unless there are mandatory minimums), judges or legal authorities often have a great deal of discretion regarding DUI penalties. This can include fines, classes, rehabilitation programs, community service and (of course) the use of Ignition Interlock Devices.
Judges will often consider:
- Previous DUI convictions or other criminal history.
- Impact on any victims, such as death or injury.
- Other extraneous factors, such as whether children are present in the motor vehicle.
Another potential pitfall is not adhering to the terms of your probation or monitoring. Violations can sometimes result in an extended requirement for an Ignition Interlock system.

SmartMobile and Court Admissibility: A Closer Look
There are several reasons why SmartMobile™ is a leading portable alcohol breath-testing solution for DUI attorneys, family attorneys, and courts. The testing data of SmartMobile is court admissible under the Frye Standard of scientific evidence, and that’s a huge advantage.
The Justice Speakers Institute was one of the first groups to conduct research and weigh in on SmartMobile’s court admissibility. Their conclusion? “Our research establishes that (SmartMobile) test results are admissible as evidence of alcohol use in a probation violation proceeding.”
See the advantages of SmartMobile
SmartMobile and Court Admissible Evidence
This is a huge benefit for attorneys who want to show the court that their client is following probation conditions. Court admissible data is uploaded from the device to our SmartWeb™ online caseload management tool. From there, it can be easily produced – and readily accepted – as proof.
That is an especially important part of the Justice Speakers Institute research. There’s no need for a hearing to determine the relevance or court admissibility of SmartMobile.
In addition, the Justice Speakers Institute said that SmartMobile’s test results are readily accepted as reliable by the scientific community. As a result, they meet the legal standards for admissibility in a probation violation hearing.
Download the Justice Speakers Institute study
SmartMobile and Probation Violation Hearings
The Justice Speakers Institute noted that for probation violation hearings, the standard of proof and type of evidence allowed are more limited than a criminal trial. Indeed, the prosecutor only needs to prove that it is “more likely than not” that a probationer violated conditions.
SmartMobile exceeds standards set by the National Highway Traffic Safety Administration (NHTSA) for evidentiary purposes. Also, the Justice Speakers Institute concluded that testing devices approved by NHTSA can be accepted in a violation hearing.
“There is a level of reliability and accuracy guaranteed by the testing device’s ability to meet or exceed NHTSA standards,” they said. “The courts have relied upon those standards.”

How a DUI Attorney Can Use SmartMobile
Stephen Pfeiffer is a noted DUI and criminal defense attorney at Wolcott Rivers Gates in Virginia Beach, Virginia. Also, he was an early adopter of SmartMobile for his clients, and helped local courts understand its usefulness.
Judges are unlikely to let someone out of custody if they’ve had a second or third-offense DUI, Pfeiffer said. However, the court can mandate SmartMobile as part of a bond condition. Also, Pfeiffer will often suggest SmartMobile as an alternative to custody for clients who are awaiting trial.
“Judges don’t have assurances that those individuals aren’t going to be consuming alcohol,” he said. “SmartMobile gives me something to provide adequate assurances. It gives the court the ability through pre-trial monitoring to see that they’re not, and act quickly if they do.”
“In my jurisdiction,” he added, “it has become a readily known and trusted system.”
However, SmartMobile’s court admissibility is only part of its versatility. Visit our website to learn more about SmartMobile as a valuable solution for monitoring DUI clients. In addition, you can also talk to your Smart Start Business Development Representative, or visit Smart Start University.

New Virginia DUI Law Relaxes Limits on Restricted Licenses
A new Virginia DUI law relaxes restricted license requirements for many first-time offenders, as long as they use Ignition Interlock. Beginning July 1, the law applies to first-time offenders with a Breath Alcohol Concentration (BrAC) of less than 0.15.
Under the new Virginia DUI law, those drivers who have a restricted license and an Ignition Interlock Device (IID) no longer have limitations on where they can drive.
The new Virginia DUI law also mandates that if a person is not eligible for a restricted license, the court can instead authorize the use of a remote alcohol monitoring device. However, that portion of the new Virginia DUI law doesn’t become effective until July 1, 2021.

New Virginia DUI Law: Unlimited Travel with Restricted License & IID
Previously, first offenders with less than 0.15 BrAC could use a restricted license only to travel to certain destinations. Under the new Virginia DUI law, however, they are now allowed unlimited travel as long as they have Ignition Interlock.
Virginia drivers with a restricted license had been limited to 14 approved destinations, including:
However, other typical destinations like shopping, going to a gas station, or running errands were prohibited.
What is an Interlock Restricted License?
Ignition Interlock Plays a Major Role
Rather than add to the existing list, legislators chose to allow any destination. However, the new law lengthens the duration of the IID requirement to 12 months, rather than six.
Now, the driver must also avoid any violations for 12 consecutive months. According to state law, the Ignition Interlock must be monitored and calibrated every 30 days.

How Do I Blow Into an Ignition Interlock Device?
One of the first things you’ll need to know if you have an Ignition Interlock Device (or IID) installed on your vehicle is how to use it properly. That starts with learning how you should blow into an Ignition Interlock Device during a test. We provide hands-on training during your installation, along with a video demonstration. You can also get 24/7/365 guidance from our Care Center that can address any of your questions about the Smart Start Interlock testing procedure.
Still, here’s a quick refresher about how to blow into our Ignition Interlock Device.
Blowing Into an Ignition Interlock Device
We ensure that our Ignition Interlock testing procedure is easy and seamless. Other vendors require you to blow, then inhale from the device, which is a troublesome and sometimes unsanitary process. Compare that with Smart Start’s Ignition Interlock tests, which only last a few seconds. Our testing supports blow-only, humming only, or a combination of blowing and humming.
Each state has different laws that regulate the correct breath pattern to blow into an Ignition Interlock Device. Be sure to use the breath pattern required by your state during an Ignition Interlock test.
Here are the three simple test patterns we use. It’s always a good idea to rinse your mouth with water before a test to ensure the most accurate results possible.
Blow-Hum
The blow-hum test requires the user to blow into the mouthpiece for a couple seconds, then transition into a hum by imitating an owl: Just say the word “whooooooooooo.” Keep your airflow consistent as you transition from blow to hum. You’ll hear a click sound from your device that tells you it’s the end of the test.
Blow
For the blow, or no-hum, pattern, all you need to do is take a deep breath and blow continuously until you hear the clicking sound from your device. It won’t take long to learn how hard or soft to blow to get a successful test.
Hum
The easiest way to perform the hum pattern is to say the word, “whoooooooo” during the test. Keep humming steadily into the mouthpiece during your Ignition Interlock test until you hear the clicking sound from your device.
Rinsing with Water and Other Testing Tips
Why Smart Start is the Most Reliable Ignition Interlock
It’s not only Smart Start’s easy test patterns that will provide a stress-free Ignition Interlock testing procedure. It’s also the technology, with a robust, fuel-cell alcohol sensor that displays the most accurate results. You can also check your next appointment date or violation points remaining from the Interlock’s keypad.

Portable Alcohol Breathalyzer Works for DUI Court Program
Stay-at-Home orders created a challenge for authorities to continue alcohol testing for DUI offenders during the Covid-19 pandemic. Fulton County DUI Treatment Court in Georgia chose a novel solution using BreathCheck™ portable alcohol breathalyzers from Smart Start.
The DUI Court Program uses a collaborative approach involving multiple legal and substance-abuse treatment professionals. The program lasts 24 months, typically combining assessment, treatment, testing, random home visits, support-group meetings and other requirements. The team works closely with program participants throughout the process to ensure individual compliance while encouraging accountability.
BreathCheck Portable Alcohol Breathalyzers as an Alternative
Bradley Jones, Behavioral Health Program Manager, said they began using BreathCheck about two weeks after Georgia’s Shelter-in-Place order took effect. He led the program along with Administrative Coordinator Cheryl Egan Fears.
Jones said that the program had used other methods of alcohol testing before Covid-19, including urinalysis. “So, we needed to find a way to make sure we continued testing during this time,” he said. “This is something we have to be doing.”
Smart Start Has the Answer
They approached Jessica Rocker, Smart Start’s Business Development Representative for their region. She suggested BreathCheck as a portable alcohol breathalyzer solution. Soon after, the program began using 120 BreathCheck devices, set up with customized random morning and evening testing schedules.
Jones said that portable alcohol monitoring isn’t just important from a deterrence standpoint, providing immediate response as opposed to urinalysis. It also helps program participants stay committed to an alcohol-free lifestyle.
“So many of our people want to prove they’re not using alcohol,” Jones said. “They really do want to show that they’re compliant. That’s why BreathCheck has been a great alternative.”
Not Just a Requirement, But Also Encouragement
For many, it’s more than just a requirement – it’s encouragement. Egan Fears says the support has been especially important given the limited contact they have with other people during the pandemic.
“There is a psychological aspect of it,” she said. “During Covid, they have been separated from their counselors and their groups. BreathCheck gives them a connection to the program, because they are always talking with each other. We want them to know that even though it is screening, we’re still watching out for them.”
Smart Start’s Business Development Rep Made a Difference
Jones gives a great deal of credit to Rocker for the BreathCheck program’s success. “She was always there to help make sure all of our clients got up and rolling,” Jones said. “Jessica has been very responsive, no matter what time we contact her, and she’s done everything she can to make it successful.”
Shelter-in-Place has ended for their area, but Jones said they’ll continue using the devices until a judicial emergency order is lifted, possibly in June. Even after that, he added, some of the BreathCheck devices may be used on a selective basis.

Choose Mobile Alcohol Testing with SmartMobile
A paper released earlier this year by the American Probation and Parole Association (APPA) emphasizes the growing role of smartphone apps for supervision. That kind of solution is easily available through our app-based BreathCheck™ mobile alcohol testing device.
But the 11-page APPA document also mentions a second mobile alcohol testing approach. The second option is a corporate-owned device rather than a client’s smartphone. We’ve got that covered too, with SmartMobile™.
BYOD vs. Corporate-Owned Mobile Alcohol Testing
The Bring Your Own Device (BYOD) approach is what BreathCheck is all about. Your client’s phone is loaded with our Client Portal app, which connects with BreathCheck. It creates an easy, compact testing solution for your clients, using the app’s Check-In capability to know where they are – anytime, anywhere.
We could devote an entire blog post to BreathCheck (and we do). But consider SmartMobile as a robust alternative that fits higher-risk clients. And Smart Start provides the device for a monthly fee, making a smartphone unnecessary.
SmartMobile Has Built-In Cellular Communication
SmartMobile is self-contained. Testing and location data are stored within the device, and it doesn’t require a smartphone or app. Instead, it has built-in cellular capabilities that keep it connected to our SmartWeb™ online case management platform. SmartWeb provides:
So Why Does SmartMobile Make Sense for High-Risk Clients?
The APPA paper points out that while the BYOD approach is generally less expensive, smartphones were not designed purely to be a secure criminal justice monitoring tool. So BreathCheck and Client Portal make sense for clients who want to comply with requirements easily and quickly.
But other clients present a greater level of risk. They either have greater potential for negative behavior as a result of alcohol use, or are highly motivated to defeat any monitoring device. That’s why we created SmartMobile.
The test data stored on SmartMobile meets the Frye standard for admissibility of scientific evidence. Even if the cellular connection is lost, the data is still safely tucked away. From a monitoring standpoint, that’s particularly important for high-risk behaviors. The device also provides automatic retests after an initial violation and lets you impose sanctions immediately when necessary.
While BreathCheck is sleek and small – no bigger than a business card – SmartMobile is larger but still easily fits in hand. It’s a robust device with full keypad and easy-to-read display screen that provides a remarkable level of interactivity with your client.
Selecting the Best Mobile Alcohol Testing Solution
We’ll give the APPA the final word when it comes to choosing a BYOD smartphone app-based solution like BreathCheck, or a corporate-owned device like SmartMobile.
“Agencies should educate themselves on the capabilities and limitations of smartphone applications in general, as well as the pros and cons of corporate-owned vs. BYOD approaches,” the report states. “These solutions, like any other, should be implemented in alignment with evidence-based practices, focusing on the risk/needs of each case.”
No two clients have the same needs. Discover the right mobile alcohol testing solution by contacting your Smart Start Business Development Rep.

What is SR-22? And Why Would I Need It?
SR-22 can be one of the more confusing parts of a DUI conviction. For starters, it’s not really “insurance.” It’s proof from your auto insurer that if your license has been suspended, you have the minimum coverage required by your state. An SR-22 is issued by an auto insurance company – and they will automatically notify your state’s Department of Motor Vehicles that you are in compliance by demonstrating financial responsibility.
We’re here to help with more than just the best Ignition Interlock Devices. We can also help you understand terms like “SR-22” and why it’s actually different from a regular insurance policy. Fortunately, we’ve got a knowledgeable partner like Freeway Insurance who can provide you with the right solution for your situation.
Watch the Freeway Insurance Video: What is SR-22?
An SR-22 Isn’t an Actual Policy
If you’re convicted of DUI, your insurance company is likely to consider you to be a high-risk driver. That means your rates are likely to go up, and sometimes your insurance may be canceled outright. Companies like Freeway Insurance and others specialize in providing insurance plans for high-risk drivers.
Once you have the correct coverage, you should receive an SR-22 document. It’s not an insurance policy, but it’s a document that proves that you meet your legal insurance obligation through a provider like Freeway. You may also see the term “Certificate of Financial Responsibility” or an FR 44 in states like Florida or Virginia. An FR-44 verifies that motorists have more than the minimum coverage.
Video: Freeway Insurance Explains the DUI Process
How Do I Know If I Need an SR-22?
Requirements for SR-22 proof vary by state. Depending on where you live, the court, judge or State Authority will notify you if you require an SR-22. They’ll also let you know the amount of time you’ll need an SR-22.
FAQs About SR-22 Requirements
What Happens if I Don’t Have an SR-22?
As always, penalties for not following the SR-22 requirement can vary by state or jurisdiction. But they can include:
An Ignition Interlock Device isn’t the only important part of your DUI requirement. An SR-22 insurance form can be equally as vital. Freeway Insurance can get you affordable car insurance and help you file an SR-22. Get a free auto insurance quote online or over the phone at (800) 777-5620.
