Removable Head Unit in Cold Weather
In most states, you can also disconnect your head unit from your curly cord and take the unit inside with you in extremely cold weather. Do not disconnect your head unit while you are driving! New York and Wisconsin do not allow clients to disconnect their head units as of February 2018!

Do you need an Ignition Interlock in West Virginia? The state’s Ignition Interlock law is all-offender, which means whether your DUI is a first or repeated offense, you will most likely need an Ignition Interlock in West Virginia.

BAC = blood alcohol concentration
* The DUI deferral program in West Virginia, or the WV DUI deferral program, is eligible for individuals with a first DUI offense with a BAC less than .15. There are other requirements in the program as well, however, such as not having a prior conviction for DUI anywhere in the U.S. The program allows the individual’s charge to be dismissed in criminal court only and their record of arrest eventually expunged from their criminal record.
** Any person who obtains a driver’s license in the U.S. or operates a motor vehicle has been deemed to have given their implied consent to provide a breath sample on request of law enforcement.

First offenses:
BAC less than .15 – At least 125 days
BAC less than .15 – At least 165 days (court deferral only)
Test refusal – at least 1 year
A BAC greater than .15 – at least 270 days
Resulting in the death of another person – at least 2 years
Resulting in serious bodily harm to another person – at least 1 year
A minor in the vehicle- at least ten months
Second and subsequent:
Subsequent admin per se violation or DUI offense, or second or subsequent refusal – At least 2 years
A second offense under 21 – at least 1 year

When Will I Need an Ignition Interlock in Pennsylvania?
If you had your driving privileges suspended or revoked in PA due to one or more violations of drinking and driving under the influence of alcohol or controlled substance, or refusal to submit to chemical testing, you have the choice to install and operate a vehicle installed with an Ignition Interlock Device during the term of your suspension or revocation, plus your Ignition Interlock-required period, thus allowing you to regain your driving privileges.
Does Pennsylvania Require an Ignition Interlock if Convicted of a DUI-related Offense?
The Pennsylvania Department of Transportation (PennDOT) will require that you apply for an Ignition Interlock Restricted License if you are suspended or revoked, and it is DUI-related.
The benefit of installing an Ignition Interlock into your vehicle is that you will be able to legally operate your Interlock-equipped vehicle during, or part of, your suspension or revocation term.
Pennsylvania’s New Ignition Interlock Limited License for First-time DUI Offenders
Act 33 in 2016 established the Ignition Interlock Limited License (IILL). This is a driver’s license issued to an individual whose operating privilege is suspended or revoked for one or more violations of driving under the influence of alcohol or a controlled substance, or refusal to submit to chemical testing.
An IILL permits an individual to petition PennDOT, if certain requirements are met, to operate a motor vehicle equipped with an Ignition Interlock system during the term, or part of the term, of their suspension or revocation.

When am I eligible to petition for the Ignition Interlock Limited License (IILL)?

How Long Will I Need an Ignition Interlock?
Each case varies regarding how long an individual may need an Ignition Interlock in Pennsylvania. In most situations, however, you will need to have an Interlock Restricted License for 1 year.
If you are not eligible, or choose not to petition for the IILL you will need to serve your full suspension period and complete all requirements as stated on your “Restoration Requirements Letter”, which is provided by PennDOT.

When Will I Need an Ignition Interlock in Washington?
Got a DUI? You may need an Ignition Interlock in Washington under most circumstances upon a DUI conviction.
Washington is an all-offender state, so whether it is your first or repeat DUI offense, you will most likely need an Ignition Interlock. The Washington State Ignition Interlock laws require first offenses with a blood alcohol concentration (BAC) of .08 will need an Ignition Interlock. You also need the device if you refused your blood or breath test. Some reckless or negligent driving convictions will require an Ignition interlock, too.
Your Ignition Interlock oversight agency will be the Washington Department of Licensing (DOL).
How Long Do I Need an Ignition Interlock in Washington?
If it is your first offense, the Ignition Interlock is a one-year requirement. For your second offense, it is five years. A third or subsequent offense is 10 years. Plus, a DUI that involves any other offenses, such as a passenger under the age of 16 in the motor vehicle, shall extend the IID requirement for six months. Keep in mind that your court can require your Ignition Interlock period to be longer!

Compliance Removal in Washington
Washington uses a certificate of compliance near the end of your Ignition Interlock requirement law period. When you’re finished with your IID requirement period, ask your Ignition Interlock vendor for the certificate.
Your vendor can submit the certificate to your State Authority if you did not do any of the following in the last 180 days or 4 months:
The 180-day compliance does not replace the 4-month compliance that the WA state has in place.
If your arrest date was before July 23, 2017, the 4-month compliance is required (the last 4 months of your Ignition Interlock device requirement period). If your arrest date was on or after July 23, 2017, the 180-day compliance is required (the last 180 days of your Ignition Interlock requirement period.)

What if I Have Asthma But Have an Ignition Interlock in Florida?
If you need an Ignition Interlock in Florida but have chronic obstructive pulmonary disease (COPD) or asthma, state regulations allow providers such as Smart Start to adjust your device so you can take each test with ease. Below you can find out what you need to do to adjust your Ignition Interlock device’s tests in Florida if you have a breathing condition such as asthma.
Adjusting an Ignition Interlock for a Medical Condition
You need to submit any medical considerations that obstruct your ability to perform your Ignition Interlock tests to the Department of Highway Safety and Motor Vehicles’ (DHSMVs’) Medical Review Board.
Your doctor must fill out an Ignition Interlock Medical Evaluation form. You can download and print this form on Smart Start’s site for your doctor to fill out. The form must only be filled out by a board eligible/board certified pulmonologist, or physician whose specialty relates to your condition.

There is an additional form that must be completed at the service center with your completed medical waiver form.
Keep in mind that if you are seeking a hardship license, you cannot receive the license until the installation of your Ignition Interlock. If you are seeking permanent reinstatement of your driver’s license, you cannot be reinstated until the installation of your Ignition Interlock.

When Will I Need an Ignition Interlock in New York?
New York is one of 34 states (plus Washington, DC) that requires an Ignition Interlock Device after any DWI offense, whether it’s the first incident or a subsequent case. You’ll always want to follow the particular rules of your jurisdiction. But you can count on Smart Start as the best way to get started when you need an Ignition Interlock in New York.
When is Ignition Interlock Required in New York?
Any discussion of Ignition Interlock requirements in New York has to include Leandra’s Law. It was passed in 2010 in memory of Leandra Rosado, an 11-year old who was killed riding in a car driven by an intoxicated driver.
Leandra’s Law requires that any person sentenced for DWI must have an Ignition Interlock Device installed on any vehicle they own or operate. Their driver’s license will include an “Ignition Interlock” restriction. The number of arrests under Leandra’s Law has continued to climb since its passage.

Ignition Interlock Requirements
An IID can be installed upon arrest from a first or second offense. The usual period with the device is a year, unless otherwise permitted by the court. New York allows individuals to obtain credit for time with an IID before sentencing.
In addition, a court must sentence a person convicted of either Aggravated DWI/Child in Vehicle or Aggravated DWI/Driving with a Blood Alcohol Content (BAC) of .18 or more to a period of probation or conditional discharge. Then, the court will require an IID on any motor vehicle this person owns or operates.
In most cases, your IID must be installed 10 days from receiving your court order. Or, if you are imprisoned for your DWI offense, you must install the IID within 10 days of being released from prison.

How Has Ignition Interlock Technology Advanced Over the Years?
Ignition Interlocks haven’t always been the reliable technology it is today. Like a lot of revolutionary products, it took some trial and error to come to the current Ignition Interlock Device.
So, how did it all start? What happened to make Ignition Interlocks what they are today?
The Taguchi Gas Sensor
Older Ignition Interlocks had a different sensor in them versus the one used now.
The Taguchi gas sensor or T-cell, named after Naoyoshi Taguchi, could detect natural gas, which means it could tell when gas was present even if it was odorless. These sensors also detected alcohol.
Ignition Interlocks with T-cell sensors were solid and jump-started the industry, but there were still some hiccups in the device’s design where users could circumvent or bypass their breath tests. In addition, the test patterns were blow-only and had no anti-circumvention features. This also allowed “curb side service”, a term that refers to an intoxicated driver finding a sober person to blow into the device for them.
Smart Start’s founders recognized this, and in 1992, Smart Start was created to provide more reliable Ignition Interlocks.
Now, the Ignition Interlock industry uses alcohol-specific fuel cell technology to maintain utmost accuracy with breath tests. Rolling retests were also incorporated under federal Ignition Interlock standards in 1992 to combat bypassing attempts like “curb side service.”
Breath Test Patterns in Ignition Interlocks
In the late 80s and early 90s, various breath patterns were introduced for Ignition Interlocks.
The breath test patterns were learned. The patterns required the user to blow, then pause, and then repeat this process a couple times. This pattern’s goal was to deter someone other than the intended user to use the device and test it.
A couple other advancements happened during this time. Temperature and pressure sensors were developed and used to determine a human versus a non-human providing a sample into the device.
Advanced anti-circumvention features today include humidity sensors and the requirement to “hum” while blowing. This technology is designed to ensure a human is delivering the breath sample.
Other Features to Ignition Interlock Technology
Advanced anti-circumvention features today include other breath test patterns such as blow-hum or straight hum. Cameras have become standard equipment on Ignition Interlocks, and identify the person delivering the breath sample.
Ignition Interlocks are an effective tool against drunk driving. In multiple studies, it’s been proven that all-offender Ignition Interlock laws reduce recidivism in offenders and reduce drunk driving fatalities.
