Each court in Ohio has an established indigent driver’s Interlock and alcohol monitoring fund. The court overseeing your OVI conviction will determine whether you are eligible to receive financial assistance through this fund or not. Your court will look at your case, an indigent client eligibility guidelines sheet, and the standards of indigence established by the state public defender. Once they make their decision, they will notify you if you are eligible for financial assistance.

What the Fund Covers

If you are eligible for Ohio’s financial assistance program, the indigent driver’s Interlock and alcohol monitoring fund will cover your various Ignition Interlock service costs. Your court will let you know what is covered specifically, depending on your needs, during your Ignition Interlock program.

When Will I Need an Ignition Interlock in Tennessee?

You may need an Ignition Interlock in Tennessee if you were convicted or arrested because of a DUI. In Tennessee, Ignition Interlocks are a requirement for most DUI cases, whether it is a first or repeat offense. You do have an option to drive sooner rather than later, however, with a restricted driver’s license.

Restricted Driver’s License in Tennessee

A restricted driver’s license is available for some DUI cases in Tennessee, but you must be eligible for this license under various circumstances. If you do have this option, you should install your Ignition Interlock before you apply for your restricted driver’s license. You can apply for this type of license with the Department of Safety’s Order for Restricted Driver License form.

First DUI Offense

For a first DUI case in Tennessee, you have the option to apply for a restricted driver’s license during your revocation (or license cancellation) period. You will have your Ignition Interlock for a minimum of 365 consecutive days.

If you chose to wait out your revocation period, you will be required to install an Ignition Interlock for a minimum of 365 days upon reinstatement of your driver license.

Second DUI Offense

A restricted driver’s license is also available under second-time DUI offenses if you install an Ignition Interlock and are otherwise eligible for the restricted license. The license revocation period will last two years.

Third DUI Offense

A restricted driver’s license is also available under a third DUI offense if you install an Ignition Interlock and are otherwise eligible for the restricted license. The license revocation period will last six years.

Fourth and Subsequent DUI Offense

A fourth DUI offense means an eight-year license revocation, but a restricted license will be an option if you are eligible. You need to install an Ignition Interlock as part of the restricted license requirements for eight years.

Additional Ignition Interlock Tips

In Tennessee, your final 120 consecutive days with the Ignition Interlock need to be violation-free to remove the device. Under any offense number, if you had two prior DUI convictions within five years, an Ignition Interlock will be a requirement for an additional six months after your license reinstatement. In addition, if you refused your breath or blood test and have a prior DUI conviction, you will be required to have an Ignition Interlock.

Any of these offenses below means a restricted license or Ignition Interlock in Tennessee is not available. You instead need to serve your driver’s license revocation period:

Vehicular Assault (serious injury to another person by a DUI driver)
Vehicular Homicide
Aggravated Vehicular Assault While Driving Intoxicated

DUI First Offense in Colorado: What to Expect

Do you know what to expect with a DUI first offense in Colorado?

If you have no other alcohol or drug-related driving convictions on your record, below is a list of what can occur as a result of a first DUI offense in Colorado.

Jail-time	Between 10 days to one year
Fines	Court costs range from $900 to $2,400, but do not include required condition fees such as alcohol classes, probation costs, insurance costs, etc.
Community Service	48 to 96 hours
Probation	This varies on your case, but can last up to two years

If convicted of a DUI, your probation sentence can include the following requirements to complete.

Attend a victim impact panel by MADD within 60 days after your hearing
Monitored sobriety for at least half the sentence if applicable
You must enroll in a Level II drug and alcohol education and treatment program. Your attorney may have already advised you to enroll before your hearing.
Install an Ignition Interlock. You may have already installed the Ignition Interlock based on your attorney’s recommendation before your court hearing/conviction.

You can expect to keep an Ignition Interlock installed in your vehicle between eight to 24 months. The period with your Ignition Interlock depends on the severity of your case, or how many DUIs you’ve been convicted of in the past.

When an Ignition Interlock is Needed For a DUI First Offense in Colorado

1^st Per Se or DUI conviction
If your BAC was under .15, you must have the device for eight months.

If your BAC was .15 or greater, you need the Ignition Interlock for 24 months.

For either situation with your BAC level, you may be able to reinstate early after serving one month of your revocation (license cancellation) period.

Chemical Test Refusals
Test refusals are an automatic two-year (or 24-month) Ignition Interlock requirement, regardless of your offense number. If you refused your chemical test, and you lose your court hearing, you cannot drive for 60 days. Then, you must comply with the same license reinstatement process and have the Ignition Interlock for 24 months.

Do I Qualify for the Tennessee Ignition Interlock Indigent Program?

Do you need to install an Ignition Interlock in Tennessee because of a DUI but need financial assistance? The state may be able to assist with the Tennessee Ignition Interlock indigent program. Let’s go over how the indigent program works, and how to apply for it.

How the Tennessee Ignition Interlock Indigent Program Works

The state manages a DUI Monitoring Fund for those with a DUI conviction who need an Ignition Interlock and are indigent. The fund provides reimbursement for Ignition Interlock program costs such as installation, removal or service appointments. The fund will not reimburse you for any damage-related fees to the device or lockout fees. The form to complete for eligibility in the Tennessee Ignition Interlock indigent program can be found on our website.

Your court of conviction will decide upon your request if you are eligible for the Tennessee Ignition Interlock indigent program. Any portion of the costs that you cannot pay will come out of the DUI Monitoring Fund. Typically, the court will deem an individual financially unable to pay for an Ignition Interlock if their annual income after taxes is 185% or less of the current poverty guidelines.

How Do I Apply for the Ignition Interlock Indigent Program?

Once the court determines that you are eligible for the Tennessee Ignition Interlock indigent program, fax a copy of the Indigent form and Order for a Restricted Driver’s License form to Smart Start at 865-288-4163. Then, make sure to schedule your installation appointment with Smart Start.

Why Do I Need an Ignition Interlock for a Drugged Driving or Marijuana-Impaired Arrest?

If you are convicted of drugged driving, you may be thinking about your list of requirements to get back on the road legally.

One requirement to check off your list to reinstate your driving privileges could be installing an Ignition Interlock Device. The device is installed into vehicles and detects your breath alcohol concentration (BrAC) before starting the car.

So, if you had drugs such as marijuana in your system when you were stopped while driving, why do you need a device that detects only alcohol?

Ignition Interlocks and Drugged Driving or Marijuana-Impaired Convictions

Most states do not distinguish between a DUI for drugs or a DUI for alcohol. In other words, your case will fall under state DUI law regardless of the substance in your system that lead to your DUI arrest or conviction.

Currently, Colorado, Illinois, Montana and Washington’s THC blood concentration limit is 5 nano-grams or higher. You could be guilty of driving under the influence if you are operating a motor vehicle with that much THC in your system, but each state’s marijuana-impaired driving laws are different.

Drugged driving convictions in most states means you will lose your driver’s license. Having a suspended or revoked driver’s license means you cannot drive unless you have limited driving privileges that was allowed by your court of conviction or state DMV office.

Here’s where Ignition Interlocks come in. If you have the option to, installing an Ignition Interlock into your vehicle means you can drive sooner rather than later during your suspended license period. An Ignition Interlock Device is installed in the vehicle, and is connected to the vehicle’s ignition system. The user must provide a breath sample into the device. An SR-22 is a certification that shows you meet the minimum driving liability limits in the state. When Will I Need an Ignition Interlock in Maryland?

Items to Take to Your Installation Appointment

Two forms of ID. One needs to be a photo ID.
Proof of residence. This can include but is not limited to a recent bill, a tax return, or another piece of formal correspondence by mail.
Vehicle registration. You will need access to a legally registered and tagged vehicle.
Proof of vehicle insurance. Maryland may require special auto-insurance for a DUI/DWI arrest or conviction, such as SR-22.
Any documents you may have received regarding your case from the Maryland MVA. If you have questions about what this might include, our Program Advisors can help.
Payment for installation and any applicable fees.

Your installation appointment will take a couple of hours. Some vehicles, like electric or hybrid vehicles, may require a longer appointment. A trained technician will install your device, demonstrate how to use it, and then provide hands on training so you’re comfortable using your Ignition Interlock system.

At the end of your appointment, you will receive written proof of installation. Bring this proof of installation and the temporary license you may have received from your arrest to a Maryland MVA location to request your restricted license¹.

Keep in mind that depending on the facts of your case, you may face additional requirements such as paying fines or completing treatment to qualify for a restricted license².

Interlock Restricted License in Maryland
