How do I know if I need to install an IID in Nebraska?

According to the Nebraska Department of Motor Vehicles website, Nebraska DUI laws offer an option for those charged with a DUI to waive their right to an Administrative License Revocation (ALR) hearing and instead apply for an Ignition Interlock Permit (IIP). To be eligible for the IIP, certain criteria must be met:

  1. Residency: You must be a resident of Nebraska.
  2. Age and License: You must be at least 18 years old and have been issued a regular driver’s license. Provisional Operator’s Permit holders are not eligible for the IIP.
  3. Location of Violation: The alcohol violation that led to the need for an IIP must have occurred within the state of Nebraska.
  4. Other Reinstatement Requirements: You must meet all other applicable reinstatement requirements for any non-alcohol-related suspension or revocation actions on your Nebraska driving record. You can check your Interlock Eligibility online for verification.
  5. Waiting Periods: You must fulfill any required waiting periods.
  6. Out-of-State Driving Privileges: You cannot have your driving privileges revoked in any other state or jurisdiction.

How do I apply for an Ignition Interlock Permit (IIP) in Nebraska?

According to the Nebraska Department of Motor Vehicles website, to obtain an Ignition Interlock Permit, you must submit the following requirements to the Department of Motor Vehicles:

  1. Complete Application or Provide Court Order: Complete the Ignition Interlock Permit Application online or download the Ignition Interlock Permit (IIP) form and mail, fax, or hand-deliver it to the Department of Motor Vehicles. Or you can provide a court order issued on/after the date of sentencing from a Nebraska court that references the Interlock requirement. See the Nebraska DMV website for more information.
  2. Certificate of Installation: If you choose Smart Start as your IID provider, we will install and send the DMV a certificate of installation showing that an approved device has been installed for each vehicle you will be operating.
  3. License Surrender or Affidavit: According to the DMV website, you must then surrender your Nebraska operator’s license/permit to the Downtown Lincoln DMV Office at 301 Centennial Mall South, Lincoln, NE, or sign an affidavit of a lost license if you no longer possess the license. This does not apply if the license has expired.
  4. Reinstatement Requirements: Fulfill all other applicable reinstatement requirements for any other suspension or revocation actions on your driving record. You can check your Interlock eligibility online.

Upon receipt of these requirements, the Nebraska DMV will send you the Ignition Interlock Permit Authorization letter. Once authorized, you can have the IIP issued online or in person.
