When Will I Need an Ignition Interlock in Alabama?
Do you have a DUI? You may need to install an Ignition Interlock in Alabama in your vehicle because for most Alabama DUI cases, the state does require the device. Let’s go over how long you’ll need an Ignition Interlock based on the different circumstances that surround a DUI case in Alabama.
Ignition Interlock in Alabama Laws
First DUI or other conviction
BAC of .08 or Greater, But Less Than .15 | Voluntary election of Ignition Interlock – The required 90-day driver’s license suspension may be lifted if you elect to install and maintain a state-approved Ignition Interlock for 90 days |
BAC of .15 or Greater | Mandatory Ignition Interlock for one year – The required, 90-day driver’s license suspension may be lifted upon proof of installation and maintenance of a state-approved Ignition Interlock for one year |
Pre-trial Diversion, Deferred Adjudication or Similar Program | Mandatory Ignition Interlock for a minimum of six months, or the duration of the program – The required, 90-day driver’s license suspension may be lifted upon proof of installation and maintenance of a state-approved Ignition Interlock during the program |
Second DUI
BAC of .08 or greater | Mandatory Ignition Interlock – After completing 45 days of your one-year driver’s license revocation, a stay of the revocation may be granted if you install and maintain a state-approved Ignition Interlock for two years |
Third DUI
BAC of .08 or greater | Mandatory Ignition Interlock – After completing 60 days of your three-year driver’s license revocation, a stay of the revocation may be granted if you install and maintain a state-approved Ignition Interlock for three years |
Fourth DUI or Subsequent DUIs
BAC of .08 or greater | Mandatory Ignition Interlock – After completing one year of the five-year driver’s license revocation period, a stay of the revocation may be granted if you install and maintain a state-approved Ignition Interlock for four years |
If you refused the breath test upon arrest, a year to your Ignition Interlock requirement period is added.
Violations for an Ignition Interlock in Alabama
If you have a driving violation during your Ignition Interlock period, the device requirement time could extend by six months. These violations include:
- A breath sample at or above a minimum BrAC of .02 that’s recorded four or more times in a month
- Any attempted tampering, circumventing or bypassing of the Ignition Interlock
- Failure to comply with the calibration or service requirements of the Ignition Interlock every 30 days
