Whether or not you participate in DUI Deferral, you may be eligible to regain limited driving privileges under the Alcohol and Drug Test and Lock Program. This program allows you to continue driving during your period of license suspension if you install an Ignition Interlock Device in your vehicle and meet the program’s other conditions.
The form to apply for the program is available through the West Virginia DMV. If you’re approved, you’ll receive a letter from the West Virginia DMV certifying your approval and eligibility for the program. Take this letter with your to get your IID installed. When the DMV has verified that your IID has been installed, you will be mailed a restricted license. You cannot drive until you have received your restricted license.
You’ll be required to complete the Safety and Treatment Program through an approved provider within 60 days of beginning the Test and Lock Program. You’ll also need to make sure you have your IID installed within six months of the date you apply for the program. Check with your monitoring authority to learn about other conditions you might need to fulfill, such as obtaining an SR-22 insurance certificate to verify your insurance coverage.
The Test and Lock Program brochure lists how long you’ll need to keep your IID installed for, based on your DUI type and whether it’s your first offense. For convenience, you may apply for the program before your driver’s license revocation begins and have your minimum revocation period added on to the required IID participation period.
When you’re 30 days from the IID removal date specified in your letter, contact the DMV to verify that you have completed all required paperwork and paid all fees. You’ll then be eligible to receive your full license back.
