According to the Arkansas Department of Finance and Administration, here’s what happens when you’re arrested for DWI in Arkansas:

Your license will be confiscated, but you may drive with a temporary driving permit for up to 30 days. Understanding Arkansas DWI Requirements

Basic DWI Requirements

We know that navigating a DWI can be overwhelming. Understanding the requirements and process after an alcohol related driving offense in Arkansas is an important step to getting back on the road. We’ve put together some general information to help you get started.

Under Arkansas law, penalties for a first offense DWI include:

  • A fine of $150-1,000
  • Six months license suspension
  • 24 hours to one year of jail time

The court can suspend the jail sentence in favor of community service. Penalties increase significantly if it’s not your first DWII within the past five years, or with certain aggravating factors such as another person being killed.

Arkansas law also requires that drivers who get a DWI equip their vehicle with an Ignition Interlock Device for a period specified by the court. Once you’ve verified with your monitoring authority that you’ve installed an IID on your vehicle, you can get your Ignition Interlock restricted license, provided you’ve met any other required conditions.

License Reinstatement

The Arkansas DFA lists the conditions drivers must satisfy before their license can be reinstated after a DWI:

  • Complete a state-sanctioned Drug and Alcohol Education or treatment program
  • Attend a Victim Impact Panel
  • Have an Ignition Interlock Device installed in their vehicle for the required amount of time
  • Pay a $150 license reinstatement fee
  • Pass all phases of the Arkansas Driver’s License Exam (if your license was revoked)

You’ll need to furnish proof that you’ve completed these requirements, then apply for reinstatement with the Office of Driver Services, as described in Arkansas Code § 5-65-307.

Once you’ve installed, you’ll need to send proof of installation back to your state authority, at which point your restricted license will be issued. Your requirement period begins once your restricted license is issued. 

Do I need the device on all of my vehicles?

The state of Arkansas says that you only need the device on any vehicle you will be operating during your time of requirement. 

What if I have a requirement, but I don’t own a vehicle?

Arkansas law dictates that any vehicle you operate during your requirement must have an Ignition Interlock Device installed, even if the vehicle is not registered to you. If you have an Ignition Interlock requirement, but you don’t own a vehicle, you may borrow a friend or family member’s vehicle to satisfy the terms of your requirement. 

How do the consequences differ for a first and second DUI/DWI? Third? Fourth?

In Arkansas, the general Ignition Interlock Device (IID) requirements for a DUI/DWI are as follows: 
  • First DUI: six months of requirement. 
  • Second DUI: 18 months of requirement.
