The New York Division of Motor Vehicles lists penalties for drinking and driving in New York State. For a first offense, these can include (but aren’t limited to):
- A fine of between $500 and $1,000 (not including court costs or other fees)
- Up to one year in jail

- License suspension of six months or more (one year if you refused a road test)

License Reinstatement
In New York State, drivers who get a DWI must typically complete an Impaired Driver Program (IDP) to maintain driving privileges while their license is suspended or revoked. IDP requirements can vary, but often include a formal substance abuse assessment, in-person IDP classes, and installing an Ignition Interlock Device.
Your monitoring authority will specify how long you have to keep your Interlock Device installed, and which specific conditions you have to follow.
