Understanding New Jersey DUI Requirements

Basic DUI Requirements

We know that navigating a DUI can be overwhelming. Understanding the requirements and process after an alcohol related driving offense in New Jersey is an important step to getting back on the road. We’ve put together some general information to help you get started.

The penalties for a DUI in New Jersey depend on your tested blood alcohol content (BAC) when arrested, as well as other aggravating factors like previous DUIs. The New Jersey Attorney General’s Office specifies that, for a first-time DUI with a BAC of 0.08% or higher (but under 0.10), you can be subject to penalties that include:

  • A $250-400 fine
  • Up to 30 days in jail
  • 3 months of license suspension by the New Jersey Motor Vehicle Commission (MVC)
  • Minimum six hours a day for two consecutive days in an Intoxicated Driver Resource Center (IDRC)
  • Auto insurance surcharge up to $1,000/year for three years

If your BAC was above 0.10%, you may be subject to higher fines, longer license suspensions, or other increased penalties. Penalties also may increase for various aggravating factors, including previous DUIs or being under the influence of other drugs.

You may also be required to install and maintain an Ignition Interlock Device as part of your DUI program. IIDs are mandatory under the law for drivers arrested with a BAC of 0.15% or higher, whether or not the driver has a previous DUI.

Finally, note that a judge may also choose to suspend your vehicle registration at their discretion. Contact your monitoring authority to find out how to restore your registration.

License Reinstatement

To get your license reinstated after a DUI in New Jersey, you’ll typically have to complete the New Jersey Intoxicated Driver Program (IDP). The IDP involves screening, classes, and/or treatment at an Intoxicated Driving Resource Center (IDRC). Your DUI program determines the required number of hours, with both 12-hour and 48-hour IDRC programs available.

Note that before your license can be restored, you’ll also have to pay IDRC fees to the state. The NJ MVC specifies the fees that may be required:

  • $100 program fee (paid to MVC)
  • $264 first curriculum fee (paid to IDRC)
  • $321 second curriculum fee (paid to IDRC)
  • $100 license restoration fee (paid to MVC)

Upon completion of your IDRC program, the IDRC will issue a recommendation to the IDP on whether or not to restore your license. For some drivers, additional treatment or classes may be required. 

If your DUI program requires that you install an Ignition Interlock Device, you’ll have to demonstrate compliance with the specific requirements. Check the license suspension letter that you received from the NJ MVC to determine how long you must keep it installed.

You will also be required to spend three years with an interlock after restoration.
