We know that navigating a DUI can be overwhelming. Understanding the requirements and process after an alcohol related driving offense in New Jersey is an important step to getting back on the road. We’ve put together some general information to help you get started.
The penalties for a DUI in New Jersey depend on your tested blood alcohol content (BAC) when arrested, as well as other aggravating factors like previous DUIs. The New Jersey Attorney General’s Office specifies that, for a first-time DUI with a BAC of 0.08% or higher (but under 0.10), you can be subject to penalties that include:
- A $250-400 fine
- Up to 30 days in jail
- 3 months of license suspension by the New Jersey Motor Vehicle Commission (MVC)
- Minimum six hours a day for two consecutive days in an Intoxicated Driver Resource Center (IDRC)
- Auto insurance surcharge up to $1,000/year for three years
If your BAC was above 0.10%, you may be subject to higher fines, longer license suspensions, or other increased penalties. Penalties also may increase for various aggravating factors, including previous DUIs or being under the influence of other drugs.
You may also be required to install and maintain an Ignition Interlock Device as part of your DUI program. IIDs are mandatory under the law for drivers arrested with a BAC of 0.15% or higher, whether or not the driver has a previous DUI.
