Understanding Delaware DUI Requirements

Basic DUI Requirements

We know that navigating a DUI can be overwhelming. Understanding the requirements and process after an alcohol related driving offense in Delaware is an important step to getting back on the road. We’ve put together some general information to help you get started.

You might face increased penalties if your DUI charge includes aggravating circumstances, such as a blood alcohol content (BAC) above .15%, or if it’s not your first DUI.

If you have no previous DUIs and you meet the other required conditions, you may qualify for the First Offender Election program. This program suspends some conditions of sentencing, but requires the driver to participate in alcohol education and treatment classes, as well as to waive their right to an administrative hearing to contest their license suspension. Ask your attorney about whether you might qualify for the FOE program.

License Reinstatement

According to the Delaware DMV, as of 2015, all drivers who get a DUI in Delaware must install an Ignition Interlock in their vehicle and keep it installed for as long as their license suspension lasts. To apply for your IID, submit the Interlock Program Application form to the Delaware DMV and pay the associated fees.

When you’re ready to have your license fully reinstated, make sure you’ve met the required conditions as listed by the DMV first:

  • Completed an approved alcohol education/treatment program
  • Paid all required fees, including $200 reinstatement fee
