What Happens After a First OWI in Iowa?

Do you know what to expect after a first OWI in Iowa? An OWI means Operating While Intoxicated and has a similar meaning to a DUI or DWI. A First OWI in Iowa Timeline

First, after your OWI arrest, the officer will inform you about a temporary restricted driver’s license that you can apply for from the Iowa Department of Transportation or DOT. This is important to know because for most OWI arrests, your driver’s license will be suspended, and you won’t be able to drive.

You may want to hire a legal representative like an OWI attorney at this time! They can assist you with the best next steps for you during your OWI case.

Your license suspension lasts 180 days (or approximately six months) if you did take the breath test. If you refused your tests, the penalties increase. Your license suspension period will last one year. However, if you did consent to the portable breath test at your time of arrest, you will have a 10-day driving permit that allows you to drive unrestricted. After 30 days, you may apply for the temporary restricted license. This means you cannot drive between days 11 through 30!

Applying for the Temporary Restricted License/Permit

Now let’s get into how you can obtain your temporary restricted license. You must install an Ignition Interlock Device in your vehicle if you pled guilty to your OWI case. An Ignition Interlock Device allows you to drive again and get back to your everyday routine. You will also need to obtain an SR-22, or proof of financial responsibility, when applying for a temporary restricted license.

The temporary restricted license allows you to travel to the following locations:

  • To and from work
  • Doctor’s appointments
  • Court appearances and counseling services
  • Driving a dependent to school or another caregiver

First OWI in Iowa Court Conviction

Your court hearing may be around the same time you are applying for your temporary restricted license. In most first OWI Iowa cases, your conviction will usually consist of the following:

  • 48-hour minimum jail sentence
  • Court fines
  • A 12-hour drinking driver education program
  • Substance abuse evaluation
  • Alcohol classes

Another possible outcome is falling under deferred judgment in your court conviction. This means that the court will not impose the sentence mandated by Iowa law, such as jail sentencing or imposing fines. Instead, deferred judgment penalties usually mean probation for a certain period. If you complete all the terms of your probation and you follow with what the judge orders, your OWI conviction record is erased. An Interlock Device could be one of these probation terms so you can drive again.
