Are Stronger Ignition Interlock OUI Laws in the Future for Massachusetts?

Massachusetts may become the next state to enact a stronger Ignition Interlock law for Operating Under the Influence (OUI) offenders. A hearing this week on implementing an all-offender law could expand the use of Ignition Interlocks to first OUI offenders.

Mothers Against Drunk Driving (MADD), an organization that lobbies for stronger drunk driving laws in the U.S., hopes that they do sign this bill into law. In addition to the all-offender law, MADD suggests compliance-based removal.

The Current Ignition Interlock Laws in All States

Some states are stricter than others when it comes to Ignition Interlocks, which are breathalyzers that OUI offenders must install into their vehicles. Currently, 30 states and D.C. enforce an all-offender law, which has been proven in multiple studies to reduce repeat drunk driving offenses. According to a recent study, all-offender Ignition Interlock laws were associated with a 7 percent decrease in the rate of drunk driving fatal crashes.

Under the current law, Massachusetts only requires Ignition Interlocks for repeat OUI offenders.

Massachusetts Improving Their Drunk Driving Laws

If Massachusetts passes an all-offender bill, they will be the 31^st state to have an effective Ignition Interlock law.

In the state, an Ignition Interlock stopped a driver attempting to start their car with a BAC level of .08 or above 31,845 times between 2006 and 2016. This number can be much higher if Massachusetts passes an all-offender Ignition Interlock law.
