What Does Compliance-Based Removal Mean?

What is Compliance-Based Removal?

First, let’s discuss the definition of compliance-based removal. Compliance-based removal is a form of exit criteria that some states use during their Interlock programs. If you comply with your Ignition Interlock requirements within a certain time period, you could have your device removed in a timely manner with the proper authorization. Keep in mind that not all states have these criteria in their Ignition Interlock programs! Each state also has its own regulations and rules regarding their Ignition Interlock programs.

In general, however, complying with your Interlock program properly means no applicable violations were recorded during the specific time period. For example, a violation could be an attempt to start a vehicle with a BrAC of .08 or higher. If no violations like this occur, you could remove your Interlock upon completion of the minimum time period.

If your state does allow for compliance-based removal, your State Authority or attorney will notify you of your options. Why Do States Use Compliance-Based Removal?

Compliance-based removal is a strong addition to a state’s Ignition Interlock law. It creates exit-based criteria to ensure an individual is ready to drive without an Ignition Interlock to ensure a safer environment on the roadways. Right now, according to MADD’s 2018 Ignition Interlock report, 20 states and DC have compliance-based removal criteria. Below are the states that have compliance-based removal.
