About the Delaware Ignition Interlock Law

In Delaware, the Division of Motor Vehicles or DMV is the overseeing authority of your Ignition Interlock requirement. If you elect to install an Ignition Interlock, you could be enrolled in one of two programs.

• The First Offense Election – The Ignition Interlock Device (FOE-IID) Diversion program is available for drivers with no previous conviction or DUI offense. In most cases, participants in the FOE-IID Diversion program must remain on their Ignition Interlock Device license for five months from the issuance date of the license.
• Voluntary – The voluntary IID program could be available for cases regarding chemical test refusals or second and subsequent DUI convictions.

Next, you’ll need to apply for an Ignition Interlock Device (IID) license to install the device. There are certain terms you must meet before applying for the IID license.

For the First Offense Election – Ignition Interlock Device (FOE-IID) Diversion program, you must meet the following terms to apply for your IID license.

• Provide proof of enrollment in a course and/or rehabilitation designated by the court with all associated fees paid.
• At least one month has passed since the day your revoked license was received by the DMV.
• Complete an Ignition Interlock Program application.
• Provide proof of insurance for the vehicle that the Ignition Interlock will be installed.
• Your driver’s license and/or privileges are not revoked for another violation that would prohibit the issuance of an IID license.

Participants who would like to apply for the IID license under the voluntary IID program must meet the following terms.

• Provide proof of enrollment in a course and/or rehabilitation designated by the court with all associated fees paid.
• If the DUI offense involved death or serious injury to another person, the driver cannot qualify for an IID license.
• Driver’s license must be surrendered to the DMV for two months for a 12-month revocation, six months for an 18-month revocation or 12 months for a 24-month revocation period.
• Complete an Ignition Interlock Program application.
• Your driver’s license and/or privileges are not revoked for another violation that would prohibit the issuance of an IID license.
• You need to have a favorable Character Background Review by the DMV. To request this form, call the DMV at 302-744-2508.
