Basic Info When You Need an Ignition Interlock in Missouri
First, let’s go over some basic information about getting a DWI in Missouri. You’ll have two components to your DWI case: One is criminal with the court system, and the other is administrative under the Department of Revenue (DOR).
This is important to know because although your ticket in court can be disposed of or reduced, the administrative components to your DWI are separate and are still in effect. Missouri imposes a separate suspension or revocation of your driver’s license under its administrative law.
Ignition Interlock Law in Missouri
Typically, Missouri automatically suspends or revokes the driving privileges of individuals convicted of a DWI. A first time DWI offense will get your license suspended for 90 days. You may be able to apply for a “restricted driving privilege” that will include the installation of an Ignition Interlock Device.
For a second DWI, you’ll normally receive a one-year revocation of your license. If you receive two DWIs in a five-year period, you could receive a five-year license denial. If you’re convicted of three or more alcohol or drug related traffic crimes, you’ll have your license revoked for 10 years.
Once you install a Missouri-approved Ignition Interlock Device, such as Smart Start’s, we will notify the DOR of your installation. The last three months of your fulfillment must be violation-free, or you will need to have the device an additional three months until there are no violations.
