When Will I Need an Ignition Interlock in Nevada?
Are you wondering if you need an Ignition Interlock in Nevada because of a DUI? For most DUI convictions in Nevada, you will need an Ignition Interlock because of its all-offender law. This law includes first DUI cases with a BAC of .18 or higher and repeat DUI cases. Starting October 2018, however, Nevada’s Ignition Interlock law will expand toward individuals with a BAC of .08 or higher.
Below is a digestible way to see if you need an Ignition Interlock below. Keep in mind that although this information covers the average DUI case, your requirements to reinstate your driving privileges is ultimately at your judge’s discretion.
DUI First-time Cases
If your BAC was .18 or higher, you’ll need an Ignition Interlock for one year. Judges can also order someone with a first-time DUI with a BAC between .08 and .17 to have an Ignition Interlock between three to six months.
Taking Effect October 2018 – First-time DUI Cases
Below is what Senate Bill 259 states for Nevada drivers, and will take effect October 1, 2018.
If this is your first DUI arrest, you will most likely need to use an Ignition Interlock. You must use it for 90 days after arrest, and upon conviction, you’ll be ordered to use the Ignition Interlock for at least six months at your judge’s discretion.
Installing an Ignition Interlock before your conviction can mean the days where you have the device will count for credit toward the time you were ordered to use the Ignition Interlock.
If you refused your BAC test, you would need to install an Ignition Interlock after arrest if you wish to drive during your one-year license revocation, or cancellation, period. Otherwise, you cannot drive at all during your revocation period.
Repeat DUI Cases
For repeat DUI cases in Nevada, the requirement for an Ignition Interlock to gain restricted driving privileges will be up to your judge. Subsequent or third-time DUI cases, however, will most likely need to install an Ignition Interlock. Typically, you can expect between 12 to 36 months on an Ignition Interlock.
