When Will I Need an Ignition Interlock in California?
Starting in January 2019, rules regarding the use of Ignition Interlock in California changed drastically. One of the biggest changes was a law that requires Ignition Interlock Devices for a number of DUI offenders.
As always, you’ll want to work closely with your attorney or with administrative officials. But here’s a quick look at what you can expect after a DUI, and whether you’ll need an Ignition Interlock in California.
Major Changes in Ignition Interlock law in California
Your requirement period with an Ignition Interlock Device in California is mainly based on the terms of your conviction and your number of DUI-related offenses within the past 10 years.
However, there is now an Ignition Interlock requirement for repeat DUI offenders, as well as first DUI offenders whose violations resulted in injury. They have to install an Ignition Interlock Device (IID) for a period of between 12 to 48 months.
The law allows those who receive a suspension under the Administrative Per Se law to obtain an IID-restricted driving privilege. They can receive credit toward any required IID restriction period if they are later convicted.

Discretion in Other Cases
Courts also can order a non-injury first DUI offender to install an IID for a period of up to six months. If the court does not order an IID, a non-injury first offender may apply for a driver license for IID restrictions. That would allow them to drive to and from their employment, as well as a DUI treatment program for 12 months.
These provisions for Ignition Interlock in California apply only to DUI violations that involve alcohol or the combined use of alcohol and drugs. They do not apply to drug-only violations.
