Maria’s Journey: The Positive Impact of Ignition Interlock

An Ignition Interlock Device is typically part of a driving requirement after a DUI or other impaired driving offense. So, it’s good to see the positive impact of Ignition Interlock with no legal requirement, provided as a show of love and hope for a family member.

Just ask Maria.

“This Was My Family, Trying to Save My Life”

She’s a stay-at-home mom who has been sober since Jan. 18, 2014. Her recovery started at a treatment center, but when she returned home, she was in for a big surprise from her family.

“My family told me that I was going to have (an IID) in order to drive,” Maria says. “I didn’t have any legal issues. There was no legal reason for me to have this on my car. This was my family, trying to save my life.”

That’s how she ended up at a Smart Start service center to get a Smart Start Ignition Interlock Device installed in her car.

Not everyone who drives drunk is a chronic alcohol user. But in her case, Maria says, the IID ended up being an important piece of her journey to sobriety.

Furious at First

Maria, who uses her blog soberblessings.com to share personal thoughts about her recovery, says she had been trying to get sober for a while.

“I didn’t start drinking heavily until my 40s,” she says. “As my kids were getting older, I had more time on my hands, and I wasn’t dealing with things very well. Alcohol took some of the edge off, and it took over more of my life than I ever wanted it to. Eventually my family was very, very concerned.”

Initially, Maria was “furious” at having to use the Ignition Interlock Device in order to drive.

The anger turned to determination. “Every day that I used it, it got easier,” she says. “I was proving to my family, but also to myself, that I could do this … that I could be sober.”

“Every time I could start the car, I was proud of myself,” she says. “It was like a gift to my family. It gave me back a sense of pride and let me give my family the comfort of knowing that we all were safe if I was behind the wheel.

“I didn’t do a ton of drinking and driving before the installation,” she adds. “But I’m sure it would only have been a matter of time before something awful might have happened. Thanks to the device, that day never came.”

Part of the Process

Maria says that the IID played a big role in her recovery process. But it was only part of a larger picture of counseling, meetings, working with a sponsor, and other parts of the process. That also includes support from her husband and their three teenagers.

“The combination of all of that is what has gotten me sober and kept me sober,” she says. “The device really helped build up my self-esteem again. I feel like I would have been on shakier ground having just gotten back from treatment and not having it on my car. The fact that it was on my car, that I didn’t even have an opportunity to screw up, helped to keep me away from the idea of drinking and driving.”

New Jersey Expands Ignition Interlock Requirement

Beginning Dec. 1, New Jersey will become the 34th state to require Ignition Interlock Devices for every drunk-driving offender. That includes first-time DUIs.

There’s no debate about the effectiveness of Ignition Interlock Devices as a way of keeping drivers safer on the road. Dozens of studies by groups like the National Institutes of Health to Johns Hopkins University confirm it. Ignition Interlock unquestionably has a positive effect on alcohol-involved crashes and fatalities.

Heavy Support for New Jersey Ignition Interlock Requirement

The New Jersey law drew heavy bipartisan support and was overwhelmingly passed last summer in the state legislature. Sen. Nicholas Scutari was one of the bill’s sponsors, along with Assemblywoman Joann Downey.

“There’s strong evidence that Interlock Devices go a long way in reducing re-arrest rates when they’re installed in offenders’ vehicles,” Downey said. “By requiring more drivers arrested for DUIs to install Interlocks in their cars, we could see a substantial reduction in alcohol-related crashes.”

Believing in the Effectiveness of Ignition Interlock

Downey said the New Jersey Ignition Interlock requirement will reduce the amount of time that a first-time offender loses their driver’s license while Ignition Interlock decreases the likelihood of a repeat offense.

“Traditionally, intoxicated drivers have also had to forfeit their driver’s license while penalized. That can keep them from getting to work or performing their duties,” Downey said. “If that leads to the individual being fired, it’s not uncommon to see emotional consequences like depression. That can encourage even more of the substance abuse that led to the penalty in the first place.

“This law creates a more humane solution that’s also more effective in the long run, making New Jersey roads safer for everyone.”

Scutari, who is a longtime proponent of the law, said it solves a major problem while striking a suitable balance.

“Drunk driving is a serious issue in New Jersey,” he said. “Having prosecuted for 16 years, my experience is that the use of Ignition Interlocks is the best way to safeguard our roads but allow minor offenders to continue their employment.”

MADD Continues Pushing for Strong Ignition Interlock Laws

Mothers Against Drunk Driving (MADD) was a heavy supporter of a New Jersey Ignition Interlock requirement. According to a MADD press release, studies show that states with all-offender Interlock laws can reduce repeat offenses by 67 percent. Also, they can reduce drunk driving deaths by 16 percent.

Steven Benvenisti, an attorney in Teaneck, N.J., was nearly killed by a drunk driver as a college student in 1989. Benvenisti has served as a MADD national board member, and is a longtime MADD volunteer. He has worked for years to pass an all-offender Interlock law in New Jersey.

“I know the anguish this violent, preventable crime inflicts on survivors and family members,” Benvenisti said. “In 2018, Ignition Interlocks kept 13,500 drunk drivers off our roads. Now this lifesaving technology will be used to its fullest potential.”

NHTSA: Drunk-Driving Fatalities Decreased 3.6 Percent in 2018

The National Highway Traffic Safety Administration (NHTSA) reports that drunk-driving fatalities declined 3.6 percent in 2018 compared with 2017. Overall, highway crash fatalities fell 2.4 percent during the same time period.

That’s a positive sign for everyone who feels that even one drunk driver is too many. However, we agree with U.S. Transportation Secretary Elaine Chao’s observation that while the trend is positive, there’s always room for greater progress.

“This is encouraging news,” Chao said, “but still far too many perished or were injured. Nearly all crashes are preventable, so much more work remains to be done to make America’s roads safer for everyone.”

Ignition Interlock Devices make driving safer

Nearly 400 Fewer Drunk-Driving Fatalities Overall

The report, compiled by NHTSA’s Fatality Analysis Reporting System (FARS), specifies an “alcohol-impaired” driving fatality as a crash involving a driver or motorcycle rider with a blood alcohol concentration (BAC) of .08 or more.

According to the data:

  • Out of 36,560 total driving fatalities in 2018, 10,511 were attributable to drunk drivers – a decrease of 397 drunk-driving fatalities compared with the previous year.
  • The overall number of traffic fatalities in 2018 dropped by 913, from 37,473 in 2017.
  • Drunk driving accounted for 29 percent of all driving fatalities in 2018. That’s the lowest percentage since 1982, when the NHTSA started reporting alcohol-related data.

Drunk-Driving Fatalities Down in 33 States & Washington, D.C.

The FARS data for 2018 showed that 33 states and the District of Columbia saw declines in the number of drunk-driving fatalities, compared with the previous year. California had the largest decrease, with 78 fewer fatalities.

Fatalities increased in 17 states and Puerto Rico. The largest increase in fatalities was in Puerto Rico (+34), followed by Montana (+22).

Which states have strict or lenient DUI laws?

Pedestrians and Pedalcyclist Fatalities Increased

The data also accounts for drunk-driving fatalities among pedestrians and pedalcyclists. Pedestrian fatalities increased by 2.2 percent between 2017 and 2018, while pedalcyclist fatalities grew by 9.2 percent.

NHTSA said it is identifying opportunities to reduce fatalities among pedestrians and pedalcyclists (bicyclists and riders of two-wheel, nonmotorized vehicles, tricycles, and unicycles powered solely by pedals).

Pedestrian fatalities occurred overwhelmingly after dark (76 percent); when pedestrians had some alcohol in their systems (38 percent); and were not at intersections (74 percent; i.e., crossing in the middle of a street or road).

Pedalcyclist fatalities often occurred after dark (50 percent); with some alcohol in their systems (26 percent); and outside of intersections (60 percent).

Deceptive Sales Practices Create an Industry Challenge

Schefter points out a problem that has surfaced in Pennsylvania and a number of other states. Many Ignition Interlock Programs will try to send DUI offenders information that looks official – in this case, like it came officially from the Pennsylvania Department of Transportation (PennDOT).

“I’ve had clients who call and tell me that they got a letter that looks very official, like it’s from PennDOT, telling them that they have to get Ignition Interlock right away,” Schefter said. “It looks like an official letter but it’s not. It’s a letter from a vendor – not Smart Start – that looks like an official notice.”

In Pennsylvania and many other jurisdictions, he said, “You need to understand that you’re going to get an official letter that’s going to notify you about your suspension. It will have a specific effective date, and all the information about your suspension.”

After that initial communication, he said, any other letter that looks like it’s official is going to be an advertisement. “It’s misleading because it looks like it’s from PennDOT, and it gives you the wrong information about your Ignition Interlock,” he said. “In my mind, this is false advertising.”

“You’re not going to get that kind of misleading advertisement from Smart Start,” he added. “They’re not going to send out false information.”
