NEWS: Alabama Changes Drunk Driving, Ignition Interlock Law

Alabama took a couple steps forward with enhancements to its drunk driving and Ignition Interlock law on July 1, 2018.

This new law, called the Curtis Wilson-Stephanie Harmon DUI Interlock Act, will expand the use of Ignition Interlocks for drivers arrested because of a DUI. Now, drivers who are under pretrial diversion, deferred adjudication or a similar program will need to install an Ignition Interlock into their vehicle if they want to regain their driving privileges.

Alabama is an all-offender Ignition Interlock state, which means those who are convicted of a DUI with at least a .08 BAC level will most likely need the device. However, when the law was passed in 2014, pretrial diversion participants were not included.

Now, these drivers can obtain an Ignition Interlock restricted driver’s license, install the device and get back on the road again.

How Long is the Ignition Interlock Requirement?

The Ignition Interlock will be mandatory for a minimum of six months, or for the duration of their program, whichever is greater. Pretrial diversion participants or those under deferred adjudication or similar programs will immediately be eligible for an Ignition Interlock restricted driver’s license.
