Alabama Close to Passing Drunk Driving, Ignition Interlock Bill
Alabama is close to enacting a stronger, lifesaving DUI law that involves Ignition Interlocks.
Alabama’s Proposed Ignition Interlock Law Change
The bill, if passed, would require more drunk drivers to install an Ignition Interlock after their first offense. The bill is pending in the House of Representatives as of March 9, 2018.
Right now, Alabama requires Ignition Interlocks for first-time offenders, but they were not a requirement for those who enter pretrial diversion programs. The bill would change this and make them a requirement for a minimum of six months or the duration of the program.
It would also mean judges can order Ignition Interlocks as a condition of bail, which will reduce fines and allow individuals convicted to drive again if they have an Ignition Interlock installed. In addition, individuals who are convicted of a third DUI offense would need to install an Ignition Interlock after the completion of their incarceration.
Finally, the bill also adjusts the Ignition Interlock indigent program structure, which is available for eligible individuals who need financial assistance. If the bill passes, those who are eligible will not have to pay for the installation, lease, calibration and removal services associated with the Ignition Interlock program. However, any program violations, optional service by the individual, or any missing or damaged equipment, must be paid.
In Alabama, Ignition Interlocks prevented individuals from starting their vehicle with a BAC level of .08 or more 719 times from July 2014 to December 2015. With more Ignition Interlocks installed, this number can increase drastically. For comparison, in Mississippi, Ignition Interlocks stopped a drunk driver 2,835 times between October 2014 and December 2015.
The enforcement of Ignition Interlocks for DUI offenders has created safer roadways in states with an all-offender law. Ignition Interlocks prevent drunk driving deaths and reduce recidivism in repeat offenders. Alabama’s proposed changes to their current DUI law means saving lives with a tool that physically prevents drunk driving.
